The Movement for Change has come to the defense of President John Mahama’s decision to suspend Chief Justice Gertrude Torkornoo, asserting that the process adheres strictly to the constitutional framework outlined in Article 146.

According to the movement in a press release, the president’s actions are well-grounded in the constitution, which serves as the bedrock of Ghana’s democracy.

“The President’s action was taken on the advice of the Council of State. It followed a prima facie determination. It adheres to the procedural framework outlined in Article 146,” the Movement for Change stated. The group emphasized that the current proceedings represent a textbook application of due process. They highlighted that the Chief Justice has been given the opportunity to respond to the allegations. This is a crucial part of fairness under the law.

The Movement for Change further argued that defending the rule of law requires allowing legal procedures to unfold without interference. This holds true even when high-ranking officials are involved.

“No one is above the law. Neither the President, nor the Speaker of Parliament, nor the Chief Justice,” the group emphasized. “Accountability is the cornerstone of our democracy, and it must apply equally to all, regardless of status or office.”

The Movement for Change acknowledged public concerns about transparency. They noted that the constitution presently does not mandate open hearings. Disclosures are also not required in such proceedings.

As a result, the group has approached the Constitutional Review Committee. They urged them to consider reforms. These reforms would increase openness in future removal processes for public officials.

The investigative committee has begun its work. The Movement for Change has appealed to the public to stay calm. They urge people to trust the constitutional process. The public is also encouraged to resist attempts to derail the investigation through political agitation or legal misrepresentation.

The group reminded all that Ghana’s democracy depends not only on elections. It also relies on the consistent, fair application of laws to all citizens. This includes those at the highest levels of government.

In a statement, the Movement for Change urged the investigative committee to conduct its work with fairness and impartiality. They warned that parties like the New Patriotic Party and the National Democratic Congress could politicize the matter. Such politicization could compromise the credibility of the outcome. This politicization undermine Ghana’s democratic principles.
