Lawyer Anyenini cries ‘hypocrisy’ over continued stay of Jean Mensah in office

Respected lawyer, Sampson Lardy Anyenini, has pointed out that the continued stay of Mrs Jean Mensah in office as Chairperson of the Electoral Commission, even after she was confirmed to have neglected to declare her assets, smacks of hypocrisy on the part of the Government of the day.

In a write-up, Lawyer Anyenini contrasts this transgression by Jean Mensah which he points out, violates the Constitution, to the supposed breach of procurement rules by her predecessor, which led to the removal of Mrs Charlotte Osei from office.

“Mrs Charlotte Osei was removed as EC Chairperson because of breaches of the procurement act. She was not found to have violated the 1992 Constitution. The breaches of an Act was enough to get her removed.

“Today, CHRAJ has in fact found that Jean Mensa and Dr Bossman Asare have in fact failed or neglected to declare their assets in clear violations of the 1992 Constitution.

“So you see the double standards in this country?” Lawyer Anyenini wrote.

The comment comes after the Commission on Human Rights and Administrative Justice (CHRAJ), confirmed, after a petition from Civil Society Organization, ASEPA, that Jean Mensah, after two whole years in office, had neglected to declare her assets as demanded by law.

After finding out the violation, CHRAJ announced that it had cautioned the EC Chairperson not to repeat the violation, and left it at that.

However, according to Lawyer Anyenini, the gravity of the violation makes Jean Mensah a more guilty person deserving of removal from the office than her predecessor whose supposed breach of procurement rules had not violated the constitution.

He however urged Jean Mensah and her deputy, Bossman Asare, to be prepared for the consequences of their actions in future.

“Jean Mensa and Dr Bossman should know that these constitutional breaches are not cured by their subsequent action of compliance.  Remember that the Public Procurement Act has a ratification mechanism to remedy violations of the Act,” he wrote.

He pointed out that, “Mrs Charlotte Osei was never offered that opportunity,’ and that, “tomorrow is pregnant.”
